Agreement to Terms

By accessing or using the services provided by FWM Fort Wayne Masonry, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of our services after any changes indicates your acceptance of the new terms.

Services Provided

FWM Fort Wayne Masonry provides professional masonry services including but not limited to brick repair, chimney work, tuckpointing, stone installations, retaining walls, and related construction services. All services are performed in accordance with local building codes and industry standards. We reserve the right to refuse service to anyone for any reason at any time.

Estimates and Pricing

All estimates provided are based on the information available at the time of inspection. Final pricing may vary if additional work is discovered during the project. We will communicate any changes in scope or cost before proceeding with additional work. Estimates are valid for 30 days from the date of issue. Payment terms will be outlined in your project contract.

Project Timeline

We provide estimated timelines for all projects, but actual completion dates may vary due to weather conditions, material availability, or unforeseen site conditions. We will keep you informed of any delays and work diligently to complete your project as quickly as possible without compromising quality.

Warranties

We stand behind the quality of our work. Specific warranty terms will be provided in your project contract and vary depending on the type of work performed. Warranties cover defects in workmanship but do not cover damage caused by natural disasters, accidents, misuse, or normal wear and tear. Material warranties are provided by the manufacturers.

Property Access and Safety

You agree to provide safe and reasonable access to the work area. We will take precautions to protect your property during the project, but you should secure or remove valuable items from the work area. We maintain appropriate insurance coverage, but we are not responsible for damage to underground utilities, sprinkler systems, or other features that are not marked or disclosed prior to work beginning.

Cancellation Policy

You may cancel a scheduled project by providing written notice. Cancellations made less than 48 hours before the scheduled start date may be subject to a cancellation fee to cover materials already ordered and scheduling adjustments. Any deposits paid are non-refundable if work has already begun or materials have been purchased specifically for your project.

Limitation of Liability

Our liability is limited to the amount paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages arising from our services. This includes but is not limited to loss of use, loss of profits, or other economic losses. Some states do not allow the exclusion of certain warranties or limitations on liability, so these limitations may not apply to you.

Dispute Resolution

In the event of a dispute, we encourage direct communication to resolve the issue. If a resolution cannot be reached, disputes will be resolved through binding arbitration in Fort Wayne, Indiana, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
